In this partition case, the trial court decreed that the plaintiff should receive a 3/5th share and the defendants a 2/5th share of the property, relying on a sketch map to show the allotments. However, the map was not initially annexed to the decree. Years later, the defendants applied to have the map made part of the decree to enable execution. The trial court allowed this amendment, but the High Court reversed it. The Supreme Court held that the sketch map, which was relied upon during trial, should have been part of the decree from the start, and the trial court's amendment was justified and necessary for effective execution. The appeal was allowed and the High Court's order was set aside.
