The Supreme Court directed the Staff Selection Commission to appoint two qualified candidates with benchmark disabilities—mental illness and specific learning disability—to Group C government posts. The candidates had cleared the 2018 Combined Graduate Level Examination and were initially recommended for the Auditor post but rejected as unsuitable for their disabilities. A January 2021 government notification identified Group C posts as suitable for these disabilities. The Court found no impediment to their appointment and ordered the SSC to forward dossiers within two weeks. If advertised vacancies were filled, supernumerary posts must be created. The judgment ensured statutory disability rights were not defeated by administrative procedures.
