The Supreme Court dismissed an appeal challenging the dismissal of a suit for declaration regarding co-ownership of an allotted property. The dispute arose from a relinquishment deed allegedly executed fraudulently in 1985, which came to light in 1991. The suit was filed in 2000. The Court held that when foundational dates and facts establishing the accrual of cause of action are specifically pleaded, limitation becomes a pure question of law and can be decided as a preliminary issue. The three-year limitation period for declaratory relief had run from 1991, making the 2000 suit time-barred. The concurrent findings of all three courts on the limitation issue were upheld as not perverse.
