In Brief
A tenant disputed findings of willful default in rent payment, claiming he had sent the money via money order which the landlord refused. The High Court reversed concurrent findings by the Rent Controller and appellate court in the tenant's favor. The Supreme Court restored those findings, holding that the tenant's defense—raised only at the High Court stage and unsupported by credible evidence (the money order amount far exceeded monthly rent)—did not justify overturning concurrent facts. The Court allowed the appeals but, balancing equities, permitted the tenant to occupy the premises until end of Diwali 2018, subject to continued rent payment and other conditions."
