Sunil Kumar Biswas and others, engaged as contract workers by the Ordinance Factory Board, filed an Original Application in the Central Administrative Tribunal seeking regularization of their services. Both the CAT and High Court dismissed their claims. The Supreme Court held that disputes regarding factual employment relationships and service regularization cannot be adjudicated in proceedings under the Industrial Dispute Act without a proper statutory reference to the industrial tribunal by the Central Government under Section 10. The appeal was dismissed.
