Sunil Kumar Sharma vs State of Rajasthan & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This criminal appeal challenged a High Court order granting bail to two accused persons in a murder case. The accused were alleged to have eve-teased the appellant's sister, and when the victim (appellant's brother-in-law) intervened, they allegedly killed him. The charge-sheet was filed under Sections 302 and 201 of the IPC. The Supreme Court set aside the bail order, holding that the allegations were serious and there was genuine risk of witness intimidation and evidence tampering. The Court found that grant of bail would not serve the interest of justice and directed the accused to surrender into custody.
