A second respondent at Guru Harkrishan Public School tendered his resignation following allegations of misbehaviour and molestation in January 1994. He later withdrew the resignation, claiming it was coerced. The Delhi School Tribunal upheld his appeal, found termination unlawful, and ordered reinstatement with 50% back wages. The school challenged the back-wages award. The Supreme Court held that Rule 121 of the Delhi School Education Rules vests the Managing Committee—not the Tribunal—with the power and duty to determine back wages and whether absence should be treated as duty upon reinstatement. The Tribunal lacks express statutory power to award emoluments. Rule 121 forms part of a coherent scheme and is not ultra vires the parent Act. The appeal was dismissed.
