Four brothers were co-tenure holders of land used as 'Abadi' (residential land) that was declared 'Chakout' (outside the consolidation scheme) after preliminary survey. One brother sold his 1/4th share without obtaining permission from the Settlement Officer. The other three brothers sued for permanent injunction, claiming the sale was void under Section 5(c)(ii) of the U.P. Consolidation of Holdings Act, 1953. The Supreme Court held that land excluded from the consolidation scheme does not require Settlement Officer permission for transfer, as it cannot be reallocated or affect the consolidation proceedings. The appeal was dismissed.
