Surender Kumar was convicted of murder under Section 302 of the Indian Penal Code by a trial court in Himachal Pradesh for inflicting fatal knife injuries on the deceased. The High Court upheld the conviction. On appeal to the Supreme Court, the appellant argued that the conviction should be reduced to culpable homicide on grounds of self-defence, sudden fight, or provocation.
