Surendra Puri vs State of Uttarakhand

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A woman was attacked and killed in a field in August 1980. Her brother and grandfather witnessed the accused hitting her neck with a sickle (Daraanti). The trial court convicted the appellant for murder under Section 302 IPC. The High Court upheld this conviction on appeal after carefully re-examining the eyewitness evidence. The appellant challenged the High Court's decision in the Supreme Court, arguing the evidence was unreliable and a witness was not examined. The Supreme Court held that the High Court's concurrent findings, based on credible eyewitness testimony and proper re-appreciation of evidence, could not be interfered with. The appeal was dismissed.
