Supreme Court of India 2018-05-11 dismissed

Suresh Singh & Anr vs State of Madhya Pradesh

Bench: 2 — Abhay Manohar Sapre

In Brief

The appellants were convicted of rioting and attempt to murder under IPC Sections 148 and 307 following a violent clash over water access between two neighbouring groups. The Additional Sessions Judge imposed seven years imprisonment for Section 307 offences; the High Court reduced it to five years while affirming conviction. The Supreme Court upheld the findings, holding that concurrent findings of conviction are not to be disturbed without showing perversity. The use of deadly weapons (axe, bhala, lathi) against multiple victims justified the sentence. The appellants' claim of self-defence was rejected. Both appeals were dismissed as devoid of merit.
