Sushil Kumar Tripathi was appointed as Assistant Professor in Political Science at Jagadguru Ram Bhadracharya University under the UGC's Tenth Five Year Plan. His appointment letter stated the post was for the Tenth Plan but "likely to be continued" based on performance and post availability. When the Tenth Plan ended on 31 March 2007, the University terminated his services, claiming the post was abolished. However, an Expert Committee reviewing the matter found the termination "perverse and incorrect"—the University had simultaneously requested the same post be continued under the Eleventh Plan, had made other Tenth Plan appointees permanent, and had given the appellant annual increments. The Supreme Court upheld the Expert Committee's recommendation, reinstating the appellant as Assistant Professor with continuity of service benefits for pension purposes, but without backpay for the period not worked.
