Syed Mohammad vs Union of India & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court held that a bank employee who did not participate in the interview for promotion from Clerk to Officer was entitled to be promoted based on his marks in the written test and performance appraisal. The Court reasoned that since the selection rules prescribed no minimum qualifying marks for the interview, non-participation did not disqualify the candidate. Under the seniority-cum-merit principle, the senior candidate was entitled to promotion if he achieved sufficient merit through the other components. The High Court's judgment requiring interview participation as a mandatory prerequisite was overturned and the appeals were allowed."
