Syed Sughra Zaidi vs Laeeq Ahmad (Dead) Through LRs. & Ors

Bench: 2 — R. Banumathi

In Brief

A landlord in Meerut sought to evict tenants whose ten-year lease (from 1968) had expired without renewal. The tenants claimed they attempted to renew but the landlord refused. The trial court and High Court dismissed the eviction suit, finding no grounds for ejectment. The Supreme Court allowed the landlord's appeal, holding that a lease renewal clause does not automatically extend tenancy; after expiry, tenants become liable to eviction. Additionally, the tenants had transferred their interest to a third party without explicit lease permission, violating the agreement. The Court ordered tenants to vacate within one year.
