T.N. Godavarman Thirumulpad vs Union of India and Ors

Bench: 3 — S. Abdul Nazeer

In Brief

An industrialist obtained a mining lease in Chhattisgarh for iron ore extraction but flagrantly violated forest conservation laws by cutting trees without permission, operating without environmental clearance, and selling ore beyond permitted captive use. He extracted over 123,000 CMT against an annual limit of 6,000 tonnes. The Central Empowered Committee found multiple illegalities in the lease grant. The State recovered demand notices, initiated disciplinary action against erring officials, blacklisted the lessee, and confiscated the ore. The Court held the State's corrective measures adequate and disposed of the petition seeking CBI inquiry, permitting authorities to auction the confiscated ore lawfully."
