In Brief
Tamil Nadu Chamber of Commerce expelled certain members without following natural justice principles. Lower courts and high courts ruled in the members' favour. Before the Supreme Court, both sides agreed to have a retired High Court judge conduct a fresh inquiry into the expulsion and submit a report. The Court appointed Justice A.R. Ramalingam for this purpose. The Court held that such voluntary agreement to judicial inquiry does not improperly override prior judgments. The expelled members retain rights to seek membership or pursue legal remedies, including offering unconditional apology for reconsideration by the Association.
