Taqdir vs State of Haryana

Bench: 3 — Uday Umesh Lalit

In Brief

Taqdir lost panchayat elections to Rakesh, who was later shot dead in a hospital during an armed attack. Taqdir was convicted by the trial court as the main conspirator. The High Court upheld the conviction based on motive and his associate's involvement in the crime. The Supreme Court acquitted Taqdir, finding insufficient evidence of conspiracy beyond a mere electoral grudge. However, the Court upheld convictions of the four actual assailants whose involvement was clearly proven by CCTV footage duly certified under Section 65-B of the Indian Evidence Act, 1872. The Court dismissed their special leave petitions challenging conviction.
