Tarlochan Singh vs Union of India and Anr

Bench: 2 — S. Abdul Nazeer

In Brief

The appellant's land (20 Marlas) was acquired in 2004 under the National Highways Act for highway widening. After an initial award of ₹1,23,050, the Arbitrator enhanced compensation multiple times. The High Court remitted the matter again to the Arbitrator. The Supreme Court, observing that the dispute had remained unresolved for over 13 years, appointed retired High Court Chief Justice Mukul Mudgal as an independent Arbitrator in place of the statutory one to expeditiously adjudicate the final quantum of compensation. The appeals were disposed with directions to the parties to appear before the newly appointed Arbitrator."
