Tekan Alias Tekram vs State of Madhya Pradesh (Now Chhattisgarh)

Bench: 2 — M.Y. Eqbal

In Brief

A blind, illiterate woman was repeatedly raped by an accused who promised marriage. She became pregnant; the accused then abandoned her. The trial and High Court convicted him under Section 376 IPC. The Supreme Court upheld the conviction. More significantly, the Court—recognizing the victim's compounded disadvantage as a blind, economically vulnerable woman living alone—awarded Rs. 8,000 monthly victim compensation for life (structured as interest on a notional Rs. 10 lakh fixed deposit). The Court also directed all States and Union Territories to formulate uniform victim compensation schemes for rape victims, especially those with disabilities, following Goa's progressive model of up to Rs. 10 lakh."
