In Brief
The Supreme Court upheld the High Court's decision striking down a retirement scheme for medically invalidated government employees. The scheme allowed such employees to continue working until age 58 or 60 if their dependents were medically unfit, or to facilitate succession within families. The Court held this violated constitutional equality guarantees (Articles 14 and 16) because it was not genuinely designed for medically unfit employees and operated as a device for perpetuating family succession. The petitions challenging the High Court's order were disposed of, confirming the invalidity of the Circular dated 20.12.2016.">
