In Brief

The High Court of Madras allowed a respondent's petition seeking refund of court fees paid in two civil appeals that were withdrawn following a private out-of-court settlement between the parties. The government challenged this, arguing court fee refunds are only available when courts formally refer parties to alternative dispute mechanisms under CPC Section 89. The Supreme Court dismissed the challenge, holding that Sections 89 and 69-A of the Tamil Nadu Court Fees Act must be interpreted liberally and purposively to cover all legally-arrived-at out-of-court settlements, including private settlements, to serve the overarching purpose of encouraging dispute resolution and reducing litigation burden. Narrow interpretation would create unjust differential treatment violating Article 14.
