In Brief
The Supreme Court reviewed two writ appeals arising from challenges to an administrative order that held properties listed in Part 'B' of the Khasgi Trust Deed belonged to the State Government. The Court held that although the properties originally vested in the State under Article XII of the 1948 Covenant with erstwhile Indore, they passed to the Khasgi Trust upon its establishment in 1962. The Trust is governed by the Madhya Pradesh Public Trusts Act, 1951, and trustees cannot alienate properties without prior sanction from the Registrar under Section 14. The Court partly allowed the appeals, set aside the High Court judgment, and directed the Registrar to initiate inquiry proceedings regarding past alienations.
