The State, Central Bureau of Investigation vs A. Satish Kumar & Ors

Bench: 2 — C.T. Ravikumar, Rajesh Bindal

In Brief

The Supreme Court upheld the Central Bureau of Investigation's jurisdiction to register and investigate corruption cases against government employees in the newly formed State of Andhra Pradesh following the 2014 bifurcation. The Court applied the principle of legal continuity, holding that the general consent and special court designations from the pre-bifurcation state remained valid. Pre-bifurcation notifications and government orders continued in force in the new states unless expressly repealed. The CBI's authority to investigate offences under Central Acts did not require fresh state consent, as established in prior decisions. The Court reversed the High Court's order quashing the proceedings and restored the criminal cases for trial.
