The State of Andhra Pradesh challenged a High Court order staying investigations into alleged corruption by a previous Government. The State had appointed a Cabinet Sub-Committee and SIT to inquire into these allegations, and later sought CBI referral. The High Court stayed proceedings, holding that a new Government cannot overturn previous Government decisions. The Supreme Court allowed the appeal, holding that investigating corruption is a valid executive function distinct from overturning prior decisions. The Court found the interim stay premature given that the Central Government had not yet decided on the CBI referral request, and directed the High Court to decide the writ petitions on merits within three months."
