A union sought wage revision for 146 workers at VVF India Limited's Mumbai units following a 2008 charter of demand. The Industrial Tribunal partially allowed the claims, granting allowance increases but rejecting demands for basic wage revision. The High Court reappreciated facts to allow the union's claims, but the Supreme Court held this exceeded judicial review jurisdiction. The Court ruled that while High Courts may examine facts in appropriate cases, they must not reappreciate evidence and substitute their findings without remitting the matter. Critically, financial capacity of the employer is material but was inadequately analyzed. The Court remanded the case to the Tribunal for fresh examination with proper evidentiary hearing.
