In Brief
This case concerns a dispute within the All India Anna Dravida Munnetra Kazhagam (AIADMK) political party over convening a General Council meeting on 11.07.2022. The party had two joint leaders—a Co-Ordinator and Joint Co-Ordinator—who disagreed on party matters, creating a functional deadlock. When the Joint Co-Ordinator could not act jointly with the Co-Ordinator, party members (2190 out of 2665) requisitioned a special General Council meeting, announced at a prior meeting held on 23.06.2022 for 11.07.2022. The Co-Ordinator challenged this, claiming the meeting was illegally convened without proper 15-day notice and without joint authorization. The Supreme Court held that for requisitioned special meetings, the 15-day notice requirement applies only to regular annual meetings, not special ones. Courts should not grant temporary injunction in internal party matters based on technical procedural faults when the substance of bylaws is not violated. The functional deadlock made joint convening impossible, and the Presidium Chairman's announcement of the meeting was not wholly unauthorised.
