Thuluva Vellalar Sangam vs R. Manthrasalam & Ors

Bench: 2 — Kurian

In Brief

This civil appeal concerned a property dispute that originated in 1970 but remained largely unenforced for decades. The High Court declined to interfere with an execution court's order citing limitation. When the matter reached the Supreme Court, the parties agreed to settle through a joint memorandum of compromise and a formal partition plan prepared by a registered valuer and chartered engineer. The Court approved the settlement, allocating portions of the property to each party (marked in colour on the plan), granted the respondents until 31 January 2018 to vacate their allotted portion, and made clear that non-compliance or unauthorised inductment of third parties would attract contempt proceedings.
