An Indian shipping company sought appointment of an arbitrator under the Arbitration and Conciliation Act, 1996 to resolve disputes with a Bangladeshi shipping agent regarding an alleged breach of an agency agreement. The respondent failed to respond to the arbitration notice. The Supreme Court examined the agency agreement and found a valid arbitration clause providing that disputes shall be determined by arbitration. Finding disputes had arisen and remained unsettled, the Court appointed a former judge as sole arbitrator to determine the dispute between the parties.
