In Brief
Trilok Chand was convicted under the Prevention of Food Adulteration Act, 1954 for sub-standard food or branding offences. He appealed, contending that the maximum penalty under the relevant provisions was only a fine, and that a beneficial amendment to the law should apply retrospectively to his pending case. The Supreme Court partly allowed the appeal, finding that the amendment was indeed beneficial to the accused and could be applied retroactively. The Court modified the sentence by imposing an increased fine as the appropriate penalty under the amended law.
