Tulsa Devi Nirola, the first wife of a deceased government servant, sought a succession certificate and family pension. The deceased had remarried and executed a settlement deed distributing his properties between both wives. He nominated only the second wife for family pension. The Court held that the right to equal family pension is conditional—it arises only if the deceased nominates more than one wife, which he did not.
