Tushar Arun Gandhi vs State of Gujarat and Ors

Bench: 2 — D.Y. Chandrachud

In Brief

The appellant challenged a Government Resolution establishing Governing and Executive Councils for developing the Gandhi Ashram Memorial. The Gujarat High Court dismissed the public interest petition based solely on an undertaking by the State's Advocate General, without calling for a comprehensive reply from the State or hearing the parties on the merits. The Supreme Court held that this summary dismissal was improper. The Court remanded the matter to the High Court to proceed with full pleadings, allow the State to file a comprehensive affidavit, and decide the substantive issues on merit. The appeal was allowed and the High Court's judgment was set aside.
