In Brief

The U.P. Avas Evam Vikas Parishad Board initiated acquisition of Khasra No. 673 to implement a housing scheme, but issued notice only to persons recorded in revenue documents as tenure holders, excluding the respondents. The High Court quashed the acquisition, finding procedural violation. The Supreme Court upheld this, holding that the respondents' absence from both public and individual notice violated their right to submit objections. However, instead of vacating the land (already developed), the Court ordered compensation under the 2013 Act, directing the Collector to assess and award compensation within six months, to be held in an interest-bearing bank deposit pending resolution of the underlying title dispute by a competent court.
