The U.P. Housing Board appealed against an order directing it to allot a flat to a person (respondent) who had registered in 1982 but never sought to participate in any lottery draw. The Supreme Court held that mere registration does not create a right to allotment. Under the Board's rules, applicants must submit written consent to participate in a lottery draw when schemes are advertised—registration alone confers no entitlement. Since the respondent never provided such consent and waited eleven years before complaining, the Court set aside the consumer forum's order compelling allotment at an arbitrary price, finding no contractual basis existed.
