In Brief
A wife and her minor daughter were granted permanent alimony by a Family Court in a divorce case under the Special Marriage Act, 1954. When the husband deposited the amount with the High Court as a condition for staying the alimony order during appeals, the High Court restricted the wife's withdrawal rights. The Supreme Court modified the order to allow the wife to withdraw Rs. 2 Crores as an interim measure, holding that she and her child cannot be denied reasonable funds for living expenses and education during the pendency of appeals, while preserving the husband's interests as the judgment-debtor."
