Uma Mahesh Bandekar, a married daughter, sought inclusion of a lease premises in her parents' estate for inheritance purposes. The lower courts and High Court excluded it, citing the Goa Rent Act's provision that married daughters cannot be tenants. The Supreme Court held that the Goa Rent Act (regulating landlord-tenant disputes) does not apply to succession proceedings. Under the Portuguese Civil Code and the Inventory Proceeding Act, 2012, married daughters have equal succession rights as unmarried daughters or sons. Lease premises are inheritable assets. The Court quashed the lower orders, held that the married daughter has succession rights in the lease premises, and directed amendment of the final partition accordingly.
