UMEDRAJ JAIN vs V. SUDARSANAN

Bench: 2 — Pamidighantam Sri Narasimha, Joymalya Bagchi

In Brief

A property buyer, who purchased land during a pending loan recovery suit against the original owners, challenged a High Court order requiring him to pay Rs. 19.54 lakhs to settle the lender's claim. After years of litigation and Rs. 1.15 crore already paid, the Supreme Court modified the decree. Rather than enforce the full amount, the Court directed a settlement of Rs. 15 lakhs as complete satisfaction of all dues, citing the wastage of time and resources in prolonged litigation. The order was specific to the case facts and not intended as precedent.
