In Brief

The Union of India challenged a lower court's quashing of a land acquisition notification issued under the urgency clause of the Land Acquisition Act, 1894. The State had acquired land sought by the ITBP with only a three-month gap between the acquisition request and the urgency notification. The Supreme Court held that this time gap did not constitute unreasonable delay. The Court also found that statutory compliance was satisfied by offering tenure holders 80% estimated compensation, even though they refused to accept it. Noting that substantial public funds and development had already taken place on 95% of the acquired land, the Court allowed the appeal and upheld the acquisition."
