Supreme Court of India 2016-09-15 remanded

Union of India and Ors vs Cipla Ltd. & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court considered consolidated appeals and special leave petitions regarding whether Diosmin should be included in Schedule I of the Drugs (Prices Control) Order, 1995. Rather than deciding the inclusion question directly, the Court declined to do so in view of its prior decision in Secretary, Ministry of Chemicals & Fertilizers v. Cipla Ltd. It remanded the matter to the High Court for reconsideration in light of that precedent. Judgment on remaining issues was reserved. An application for intervention was dismissed.
