The Appellate Authority found the charges not fully proven because critical witnesses—the Additional DIGP, the STD booth owner, and a co-worker—had never been examined. The High Court quashed the penalty. The Supreme Court upheld the High Court's decision, finding the omission of vital witnesses was a serious procedural defect that vitiated the entire proceeding. The appeal was dismissed and the respondent awarded full arrears."
