Union of India & Anr vs Satish Kumar Mehta (D) thr. Lrs

Bench: 2 — Kurian

In Brief

The Union of India sought misuser charges of Rs. 42,11,604 from Satish Kumar Mehta for his use of a residential property for non-residential purposes through a sub-tenant. The respondent claimed the charges could not exceed Rs. 10,31,630, as stated in his plaint. The Single Judge upheld this reduced amount. When the appellants appealed, the Supreme Court held that the respondent had made an unequivocal admission in the plaint limiting charges to Rs. 10,31,630, from which he could not subsequently retreat. The Court accordingly upheld the Single Judge's decree and partly allowed the appeal, noting that amounts already paid would be adjusted against the decretal amount.">
