In this criminal appeal, the Supreme Court reversed the High Court's order that had quashed charges against the respondents for offences under Sections 120B, 420, 477A of the IPC and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. The respondents, including Shyamal Chakravarty and the Bhalotia directors, challenged charges relating to submission of bids with antedated cheques. The High Court had found the proceedings unmaintainable for lack of allegations against their company. The Supreme Court held that such threshold interference was improper and allowed the trial to proceed, directing it be completed expeditiously while reserving all questions on the merits of the accused's defence for the trial court's consideration.
