The Union of India challenged a Central Administrative Tribunal's decision granting benefits to railway employees based on the LARSGESS Scheme. The Tribunal and High Court upheld the claim, but the Supreme Court found this approach flawed. Since the LARSGESS Scheme had been adversely reviewed by courts and terminated by the government, it could not form a valid basis for conferring rights. The Supreme Court had consistently refused to recognize any rights under the scheme. The appeal was allowed, the Tribunal and High Court's decisions were set aside, and the respondents' claim was dismissed.
