An Army Medical Corps officer was granted study leave to pursue a specialization in Prosthetic Surgery at the University of Miami for 24 months, later extended by 12 months. Although the extension was sanctioned by the President of India, the Union ceased paying his allowances after April 1993 and rejected his pay claim in 2004. The Supreme Court upheld the Armed Forces Tribunal's decision that Army Instructions 13/1978 entitle him to full pay during the extended study leave period. The Court directed payment of all outstanding dues with interest and held the entire study period counts towards retiral benefits."
