A Constable of the Border Security Force assaulted his superior officer with a rifle butt on 19 February 2000, causing serious injuries including a fractured scapula and facial injuries. A departmental enquiry led to dismissal. The High Court reduced the punishment to stoppage of three increments and ordered reinstatement. The Supreme Court reversed this, holding that assault on a superior officer by a disciplined force member warrants dismissal. Given the serious injuries, the weapon used, and the respondent's prior misconduct, the severe penalty was justified and the appeal was allowed.
