Union of India & Ors vs Ex. Naik Ram Singh

Bench: 2 — Abhay S. Oka

In Brief

Ex-Naik Ram Singh sought disability pension after being invalidated from military service due to an 80% assessed disability from a road accident sustained while on authorized annual leave. The Armed Forces Tribunal granted him lifelong disability pension with arrears and interest. The Supreme Court reversed this, holding that a disability is only pensionable if attributable to military service with a reasonable causal connection. Since the accident occurred two days after the respondent reached his leave station (not while travelling to/from duty), there was no nexus to military service, rendering him ineligible for disability pension despite the severity of his disability."
