Supreme Court of India 2020-02-04 dismissed

Union of India & Ors vs Gopaldas Bhagwan Das & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The Union of India appealed a judgment that had found it unlawfully acquired land without properly establishing the appellants' rights. The Union argued that the judgment should not have quashed the entire Section 4 notification since the appellants' claim was limited to 50 per cent of the land. The Supreme Court dismissed the appeal, holding that while declarations of law binding under Article 141 differ from orders in specific cases under Article 142, the trial court's order was justified because it had already acknowledged the appellants as legal heirs of Ismail and noted another claimant's rights to the remaining portion.
