A medical officer in the Army was court-martialed for allegedly accepting money to alter a recruit's fitness assessment. He was convicted and dismissed. The High Court set aside the conviction because a junior-ranked officer served as Judge Advocate without recorded reasons in the convening order. The Supreme Court upheld this decision, holding that the rank requirement for a Judge Advocate protects the accused's dignity and ensures fair trial. Subsequent alteration of official documents to add missing reasons was unauthorized. The Court rejected arguments based on procedural rules that a defect in appointing an unfit Judge Advocate could be overlooked.
