Union of India & Ors vs Lt. Colonel Dharamvir Singh

Bench: 2 — Dhananjaya Y. Chandrachud

In Brief

A Lieutenant Colonel in the Indian Army was attached to another unit pending disciplinary action over alleged breaches of discipline and security lapses. He challenged the attachment order before the High Court of Manipur under Article 226, and the High Court stayed the order. The Supreme Court held that High Courts lack jurisdiction to entertain writ petitions challenging military disciplinary orders. Such matters are exclusively within the Armed Forces Tribunal's jurisdiction under the Armed Forces Tribunal Act 2007. The Court set aside the High Court's orders, finding that judicial interference with military discipline was misconceived and undermined the essential hierarchical authority of the armed forces.
