Supreme Court of India 2016-12-02 disposed

Union of India & Ors vs Paliwal Overseas Pvt. Ltd

Bench: 2 — Kurian

In Brief

This case concerned consolidated appeals challenging amendments to Section 80 HHC of the Income Tax Act, 1961. The Supreme Court held that Section 80 HHC, as amended in 2005, operates prospectively only. The Court also clarified that Section 80 HHC applies uniformly to businesses with turnovers both below and above 10 crores. Relying on its earlier order in C.I.T.-5 v. M/s. Avani Exports, the Court disposed of all appeals on the settled principle that the amended provision has only prospective effect and uniform applicability across turnover categories."
