In Brief
This case concerns ministerial cadre employees in the Border Security Force who challenged the non-implementation of a 2000 decision creating promotional posts for them. The High Court had ordered implementation, but the Supreme Court reversed this. The Court held that a cadre review decision of 2003—which expressly superseded all prior orders and restructured the entire BSF staffing from Constable to DIG—validly replaced the 2000 decision. No eligible candidates existed during the interim period. The Court concluded that cadre reviews and promotional policies are matters for the employer to decide; courts cannot interfere unless decisions are wholly arbitrary or perverse.
